7 WHEREAS, an abundance of overgrown grass or weeds: 8 9 1. is injurious to the public health, safety and general welfare by providing a breeding 10 ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12 3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13 such property; and 14 4. may also pose a fire hazard and respiratory hazard; and 15 16
WHEREAS, §11-67-1 et Seq., of the Code of Alabama, 1975, as amended, permits 17 18 the City Council of the City of Prattville to declare an abundance of overgrown grass and 19 20 weeds to be a public nuisance; and 21
22 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 23 24 the properties at the following addresses and determined the existence of an abundance of 25 26

Elmore County Revenue Commissioners, are ordered to abate the abundance of 9
overgrown grass and weeds; and 10 3. the owners of said property are ordered to appear before the City Council of the City of 11 Prattville at a public hearing at 6:00 p.m. on July 21, 2020 in Prattville City Hall. WHEREAS, the quadrennial Municipal Election of the City of Prattville, Alabama, 7 8 shall take place on Tuesday, August 25, 2020, and the Run-Off Election, if necessary, shall 9 10 be held on Tuesday, October 6, 2020, pursuant to §11-46-22 Code of Alabama, 1975, as 11
12 amended; and 13 14 WHEREAS, the incumbent Mayor anticipates being a candidate in said Prattville 15 16

7 {Sponsored By: Council President Pro Tempore Brown} 8 9 WHEREAS, the City of Prattville, Alabama, has identified a need to improve Maple 10 11
Street Drainage; and 12 13 WHEREAS, §22-34-1, et seq., Code of Alabama, 1975, as amended, and regulations 14 15 in ADEM Administrative Code Chapter 335-11-1 authorize the making of loans to aid in 16
17 financing the cost of construction of necessary wastewater/stormwater treatment; and 18 19 WHEREAS, the Maple Street Drainage Improvement Project is an eligible project; and 20 21
WHEREAS, the City desires to retain engineering services for said project in the event 22 23 said application is approved; and 24 25 WHEREAS, §41-16-51(a)(3) Code of Alabama, 1975, as amended, allows contracts to 26
27 secure services with consultants possessing a high degree of professional skill to be let 28 29 without competitive bidding; and 30 31
WHEREAS, the City shall seek reimbursement of CWSRF funds for all necessary 32
33 engineering fees paid from City funds in the event the application is approved. 34 35 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville as 36
37
follows: 38 39 1. That Mayor Bill Gillespie, Jr. is hereby authorized to file an application for a 40 loan to be made by the Alabama Water Pollution Control Authority on behalf of 41
the City of Prattville. 42
43 2. That Mayor Bill Gillespie, Jr. is hereby designated as the Authorized 44 Representative of the City of Prattville and is authorized to file all necessary 45 documents required by the Alabama Department of Environmental Management 46
(ADEM) in connection with this application. 47
48 3. That certified copies of the Resolution will be included as a part of the 49 application to be submitted to the Department. 50 51
4. That Civil Southeast, Inc. be retained to provide necessary engineering 52 services. 53 54 BE IT FURTHER RESOLVED that the City Council of the City of Prattville does hereby 55

BE IT FURTHER ORDAINED that the real property described below is hereby 17 18 declared surplus of the City of Prattville: 19 20 Parcel 3 of the Corrective Map of South Industrial Park Plat No 1, as recorded in Plat Book 2017 at Page 21
20 in the Office of the Judge of Probate, Autauga County Alabama. Containing 16.67 acres, more or less, 22
and lying in the SW 1/4 of the SW 1/4 of Section 22, T-17-N, R-16-E, Autauga County, Alabama. 23
LESS AND EXCEPT an 130’ wide parcel, described as follows: 24
Begin at a found concrete marker known as the Southwest Corner of Section 22, T-17-N, R-16-E, Autauga 25
County, Alabama; thence N 00°10’55” W 130.00' to a set iron pin; thence N 89°17’51” E 944.88' to a set 26
iron pin located on the West R.O.W. (220') South Industrial Park Drive; thence along said West R.O.W. 27
