7 WHEREAS, an abundance of overgrown grass or weeds: 8 9 1. is injurious to the public health, safety and general welfare by providing a breeding 10 ground and shelter for rats, mice, snakes and mosquitoes and other vermin; 11
2. may cause the further spread of weeds; 12 3. may hide debris, such as glass or metal, that could inflict injury on a person going to 13 such property; and 14 4. may also pose a fire hazard and respiratory hazard; and 15 16
WHEREAS, the City Council of the City of Prattville declared in Resolution Book 17 18 2020-A, Page 074, that the abundance of overgrown grass and weeds at various addresses 19 20 in the City of Prattville constituted a public nuisance and set a public hearing to discuss said 21
22 nuisances; and 23 24 WHEREAS, notice, as required by §11-67-62, Code of Alabama, 1975, as amended, 25 26
was provided in The Prattville Progress, by certified mail, and by signage on the subject 27 28 property; and 29 30 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected 31
32 said properties and determined that the public nuisance still exists; and 33 34 WHEREAS, the City Council held the required public hearing at 6:00 p.m. on 35 36
August 4, 2020, permitting the owners of said properties to present evidence, objections, 37 38 and protest regarding the proposed removal of weeds. 39 40 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of 41
42 Prattville declares that the abundance of overgrown grass and weeds on the properties 43 44 continue to be a public nuisance: 45 46

removal of overgrown grass and weeds and report such cost to the City Council following 64

WHEREAS, a regular quadrennial Municipal Election has been called to be held on 7 8 August 25, 2020, and a run-off election, where necessary, on October 6, 2020; and 9 10 WHEREAS, Section 11-46-27 of the Code of Alabama, 1975, as amended, provides in 11
12 part that the municipal governing body, not less than 15 days before holding of a Municipal 13 14 Election, appoint from the qualified electors of the voting districts officers to hold the elections 15 16
as follows: where electronic vote counters are used, an Inspector and at least three Clerks 17 18 are required for each electronic vote counter. 19 20

[To Certify Marcus Jackson as the District 2 Councilor for 2020-2024 Quadrennium.] 1
2 {Sponsored By: Council President Striplin} 3 4 WHEREAS, §11-46-20 through 11-46-73, Code of Alabama 1975, as amended, 5 6
provide for and regulate general and special elections in cities and towns of this 7 8 state, except those cities and towns which have a commission form of government; and 9 10 WHEREAS, §11-46-43 Code of Alabama 1975, as amended, prohibits write-in 11
12 candidates in elections held under Sections 11-46-20 through 11-46-73 of the Alabama 13 14 Code of 1975, as amended; and 15 16
WHEREAS, §11-46-26 of the Alabama Code of 1975, as amended, provides 17 18 that if only one person has filed a statement of candidacy or has been nominated for an 19 20 office for an election to be held pursuant to §11-46-20 through §11-46-73 of the 21
22
Code of Alabama 1975, as amended, at the time the deadline for qualification has 23 24 passed, then such person shall, for all purposes, be deemed elected to such office, and 25 26
the mayor or other chief executive officer shall not cause the name of such person or the 27 28 office for which his candidacy was declared to be printed on the ballot, but he shall 29 30 immediately file a written statement with the governing body of the municipality, attested 31
32 by the clerk, certifying the fact that only one person filed a statement of candidacy or was 33 34 nominated for the office preceding the deadline set for an election of municipal officers of 35 36
the municipality and setting forth the name of such person; and 37 38 WHEREAS, §11-46-26, Code of Alabama 1975, as amended, provides that the 39 40 governing body of the municipality, after receiving such statement, shall adopt a 41
42 resolution declaring the person named in the statement duly elected to the office 43 44 described in the statement, and shall issue a Certificate of Election to such person; and 45 46
WHEREAS, the Mayor of the City of Prattville has filed a written statement with the 47 48 governing body of the municipality, attested by the Clerk, certifying the fact that only one 49 50 person filed a statement of candidacy for the office of City Council District 2 prior to the 51
52 deadline and that the name of that person who filed such statement was Marcus Jackson. 53 54 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Prattville 55

7 WHEREAS, the Alabama Legislature enacted Act 2013-297 empowering the City 8 9 Council of the City of Prattville to authorize the sale and distribution of draft beer for on- 10 11
premises consumption by retail licensees of the Alcoholic Beverage Control Board; and 12 13 WHEREAS, the Alabama Legislature enacted Act No. 2020-150 empowering the City 14 15 Council of the City of Prattville to authorize the sale and distribution of draft beer in growlers 16
17 for off-premises consumption by retail licensees of the Alcoholic Beverage Control Board. 18 19 BE IT ORDAINED by the City Council of the City of Prattville, Alabama as 20 21
follows: 22 23 Section 1. The sale of draft beer for on-premises consumption by retail licensees of 24 25 the Alabama Alcoholic Beverage Control Board within the corporate limits of the City of 26
27 Prattville is hereby authorized. 28 29 Section 2. The sale of draft beer in growlers for off-premises consumption by retail 30 31
licensees of the Alabama Alcoholic Beverage Control Board within the corporate limits of the 32 33 City of Prattville is hereby authorized subject to the condition that the growler or similar 34 35 container shall be no larger than 64-ounces, but may not include the sale of keg beer for off- 36
37 premises consumption. 38 39 Section 3. Any violation of the offenses set forth shall be a misdemeanor punishable 40 41
by a fine of not less than $100 nor in excess of $500. In addition, in the case of a violation by 42 43 the retail licensee, upon conviction of such offense, the City Council of the City of Prattville 44 45 may suspend or revoke the business license issued by the City. 46

Section 4. The words or phrases which appear in this ordinance shall have the 48 49 definition for meaning ascribed in Section 28-3-1, Code of Alabama 1975, unless the context 50 51
clearly indicates otherwise. 52 53 Section 5. All ordinances or parts of ordinances are superseded and repealed to 54 55
the extent that the same are in conflict herewith. 56
57 Section 6. This ordinance shall become effective upon passage, approval and 58 59 publication or as otherwise provided by law. 60
