The proposed 36 lot 44 subdivision is an extension of the Midtown Oaks Subdivision. He stated that staff recommends 45 approval contingent upon property is rezoned to R-3, construction plans fully approved by staff, 46 stormwater plans fully approved by staff, and final plat to include stormwater easement and detention 47 areas. 48 49 Juan Gacha of Goodwyn, Mills & Cawood, Inc., stated that the proposed plat is continuing as the 50 previous Midtown Oaks development. He stated that they plan to continue to Plat 6. 51 52 Chairman Smith opened the floor for public comments. Mrs. Carpenter seconded the motion. 57 58 During the Commission’s discussion they expressed concerns about the development’s continuance 59 without a master plan for future development. 60 61 After their discussion, the vote was called. The motion to approve passed unanimously. 62 63 6. Preliminary Plat: Park Place Plat #1 64 Location: College Street 65 Petitioner: Evelyn Doster Holdings, LLC 66 67 Ed Rouze, petitioner, was present as representative for the preliminary plat of Park Place Plat #1. 68 69 Mr. Stephens introduced the preliminary plat of Park Place Plat #1. He stated that the property is zoned 70 R-2, single-family residential and the proposed lots do not comply with the zoning requirements. The 71 petitioner received Board of Zoning Adjustment approval (12/19/2019) to allow the varied setback 72 requirements making the existing lots legal non-conforming. 73 74 Chairman Smith opened the floor for public comments. Subdivision Regulations Amendment: Flag Lots 83 84 Mr. Stephens presented the proposed amendment to the Subdivision Regulations to address flag lots as 85 reviewed by the committee. 86 87 Chairman Smith introduced a resolution recommending approval to amend the Subdivision Regulations, 88 Article V, Section F.-Lots and moved for its approval. Mr. Gardner seconded the motion. 89 90 Chairman Smith opened the floor for public comments. There being none, the public hearing was 91 closed. 92 93 Mrs. Carpenter moved to amend the amendment as presented to include that (f.) prior to a certificate of 94 occupancy being issued, an all-weather driveway surface shall be in place.
