and 10 11 WHEREAS, the Alabama Historical Commission is the state administrator of the 12 13 Certified Local Government program; and 14 15 WHEREAS, the City of Prattville desires to participate in the program in order to 16 17 identify, evaluate, and protect cultural resources; and 15 16 WHEREAS, the Fifth and Fourteenth Amendments to the United States Constitution 17 18 provide for the protection of human life and liberty; and 19 20 WHEREAS, the Supreme Court of the United States in Poelker v. Doe (432 US 519, 21 22 1977) concluded that ''the Constitution does not forbid a state or city, pursuant to democratic 23 24 processes, from expressing a preference for normal childbirth" instead of abortion; and 25 26 WHEREAS, state police power derives from the Tenth Amendment to the United 27 28 States Constitution, which gives states the powers "not delegated to the United States," and 29 30 WHEREAS, the power to establish and enforce laws protecting the welfare, safety, 31 32 and health of the public is a core function of the state's police power; and 33 34 WHEREAS, this City desires to express its deep concern that all human beings, at 35 36 every stage of development, including before birth, in the City of Prattville should be afforded 37 38 protection from acts of cruelty, and be treated humanely and with dignity. 39 40 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Prattville 41 42 that: 43 44 1. the City of Prattville hereby recognizes and declares the humanity of the pre-born child and 45 urges the citizens of Prattville to encourage the humane treatment of all human beings, 46 including the preborn child, as well as to promote and defend the dignity of all human life. 47 48 2.
