Absent: Mayor Bill Gillespie, Councilman John Chambers, and Mr. Seth Hayden. (Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Darrell Rigsby, Senior Planner; Mr. Tommie Williams, Planner; and Ms. Alisa Morgan, Secretary. Minutes: Mr. Mullins moved to approve the minutes of the August 19, 2021 meeting and the September 1, 2021 work session. Mr. Daniel seconded the motion. The motion passed unanimously. Committee Reports: Mr. Stephens provided an update on the progress of the Zoning Ordinance rewrite which was the topic of the September 1st work session. Old Business: 1. Preliminary Plat: Prattville Square Shopping Center Plat 1 Location: North Memorial Drive Owner: Tanner & Guin Representative: Flowers & White Engineering, LLC This agenda item was postponed at the August meeting at the petitioner’s request. Mr. Rigsby presented the preliminary plat of Prattville Square Shopping Center Plat 1. He stated that the plat proposes to combine two parcels that currently include Prattville Square Shopping Center buildings and three outbuildings. Additionally, this subdivision proposes to cut out an outparcel that borders North Memorial Drive creating two new parcels, Lot A, approximately 8.11 acres, including Prattville Square Shopping Center and one outbuilding and a smaller parcel, Lot B, approximately 1.02 acres, bordering North Memorial Drive that includes First Franklin Financial (111 North Memorial Drive) and the former Fountain City Pharmacy (105 North Memorial Drive) buildings. He stated that all parcels as part of this subdivision have sufficient street connectivity to North Memorial Drive and Wetumpka Street and all parcels also have access to existing water and sewer facilities. He stated that the plat creates a non-conforming lot due to setbacks in B-3 zoning district and the petitioner is requesting a waiver to the subdivision regulations to address the non-conformance. He stated that the staff recommends approval contingent that the proposed waiver is approved. Ken White, Jr. of Flowers & White Engineering, LLC, petitioner’s representative, presented the preliminary plat of the Prattville Shopping Center Plat 1. He stated that the waiver request is for the setback only. He stated that the shared access will remain. Chairman Smith opened the floor for public comments. There were none to speak. The public hearing was closed. Mrs. Carpenter introduced a motion recommending approval of the preliminary plat of the Prattville Square Shopping Center Plat 1 and moved for its approval. Mr. Mullins moved to amend the motion to approve contingent that the submitted proposed waiver is granted to allow the nonconforming lot. Mrs. Carpenter seconded the motion. The amended motion to approve passed unanimously. New Business: 2. Preliminary Plat: Smith Property Phase 2 Location: Highway 31, Highway 82 and McQueen Smith Road Owner: H. D. & D. Land Company Representative: Barrett-Simpson, Inc. Mr. Williams introduced the preliminary plat of Smith Property Phase 2. He stated that the approximately 51.49 acre lot will be subdivided for a 38.75 acre lot for 85 single family residential lots and three commercial outparcels. The proposed plat has access from McQueen Smith Road and Highway 31, but no access from Highway 82. Mr. Mullins asked if there is a traffic study. Blake Rice of Barrett-Simpson, Inc., petitioner’s representative, presented the preliminary plat of Smith Property Phase 2. He stated that city staff have not required a traffic study. He stated that Lot 1 has been reserved for anticipation of the McQueen Smith widening and improvements have been made for both entrances. Chairman Smith opened the floor for public comments. Lee Reynolds, adjacent property owner, stated that he had no objection to the proposed development but spoke on concerns for the need of McQueen Smith widening and drainage. Jon Lee Finnegan, 211 Deer Trace, spoke on traffic concerns and the need for a traffic light. The public hearing was closed. Chief Johnson introduced a resolution recommending approval of the preliminary plat of Smith Property Phase 2 and moved for its approval. Mrs. Carpenter seconded the motion. Mr. Rice stated that he spoke with Mr. Reynolds and had discussion about his drainage concerns. He stated that the data was emailed to the city’s staff. He stated that he is willing to meet with Mr. Reynolds and the city’s engineer to discuss the drainage plan’s concept. Mr. Stephens stated that the timing is undetermined on when a traffic light will be placed at the intersection of Highway 31 and McQueen Smith Road. After their discussion, the vote was called. The motion to approve passed unanimously. 3. Preliminary Plat: Guardian Credit Union Plat 1 Location: 1794 E. Main Street Owner: Guardian Credit Union Representative: Flowers & White Engineering, LLC Mr. Rigsby introduced the preliminary plat of Guardian Credit Union Plat 1. He stated that this plat was presented and approved by the Prattville Planning Commission seven years ago (2014), however, the plat was never recorded at the Autauga County Probate Office before expiring. Ken White, Jr. of Flowers & White Engineering, LLC, petitioner’s representative, presented the preliminary plat of the Guardian Credit Union Plat 1. Chairman Smith opened the floor for public comments. There were none to speak. The public hearing was closed. Memorial Drive and surrounding area Petitioner: City of Prattville Mr. Stephens introduced the zoning request of the property located on 1715 and 1717 South Memorial Drive and the surrounding area. He stated that the property is incorporated into the city’s limits but is not zoned. He stated that the B-2 zoning is in line with the Future Land Use Map and the current use will remain the same. Chairman Smith opened the floor for public comments. Jon Lee Finnegan, 211 Deer Trace asked questions about who owns the 1717 S. Memorial Drive property and their involvement. Mr. Stephens stated that he had spoken with the property owner (Mr. Jarrett) and he has received proper notification of the public hearing. After no further comments, the public hearing was closed. Chairman Smith introduced a resolution recommending approval of the zoning amendment of the 1715/1717 S. Memorial Drive and surrounding area to B-2 and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. Miscellaneous Business: Mr. Stephens introduced Jason Fondren, consultant with KPS Group, who presented for discussion the proposed revisions of the Zoning Ordinance, Article 10, Article 11 and Article 12. Adjourn: There being no other business, the meeting was adjourned at 4:26 p.m. Respectfully submitted, Alisa Morgan, Secretary Prattville Planning Commission Darrell, As discussed, my client would like to request a waiver to the subdivision regulations, specifically the following sections: Appendix B - Subdivision Regulations Article V.- General Requirements and Minimum Design Standards Section A.- Conformity to 1=general community plan (1)    All proposed subdivisions shall conform to the city zoning ordinance and the community plan. Article V. General Requirements and Minimum Design Standards          Section F. – Lots. (1)    Layout: Lot sizes, width, depth, shape, and orientations, together with minimum building setback lines, shall be appropriate to the location of the subdivision, the zoning, and to the type of development or use intended. Lot B, as depicted on the plat, is excluded from the collateral my client possesses. This is the reason Parcel B was created and shown on the plat. In creating this lot, the existing buildings lying within Parcel B fell within 35’ from the rear property line and created a non compliant lot. Actually, the south building is within the minimum setback on the south side of the lot and is currently in violation of the subdivision regulations. My client formally requests a waiver to the subdivision regulations to allow the existing buildings to fall within the 35’ setback. We cannot meet the requirements of the Zoning Ordinance and Subdivision Regulations with this outparcel. If any additional information is needed, please do no hesitate to contact me. Respectfully, H. Circle K Stores originally submitted this for rezoning. In order to include adjoining property (Jarrett property) in the zoning process, City staff decided to become the applicant for this request. E. COMPREHENSIVE PLAN: The subject site has a Future Land Use Map (FLUM) designation of Mixed-Use Commercial. On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcels in a Mixed-Use Commercial area. The property is currently incorporated but unzoned. The proposed Zoning Map Amendment to B-2 meets the general fabric and pattern of the area.
