8 WHEREAS, 2650 LLC d/b/a Adrienne's Bar has applied for an amended Lounge Retail
9
10 Liquor -Class I License for a business located at 121 West Main Street, Prattville , AL 36067 ,
11
12 which is a lounge; and
13
14 WHEREAS , the applicant has requested an extension of the approved area whereby
15
16 outdoor a lcohol sales may occur; and
17
18 WHEREAS, the proposed extended outdoor space is located on a City public access
19
20 easement and w ill require an executed usage agreement; and

2 2 WHEREAS, a public hearing was set by Resolution Book 2022 , Page 033, and held at

24 6:00 p.m . on April 19, 2022 , and that at s uch time and place all persons who desired had an
25
26 opportunity to be heard in favor of or in opposition to such resolution .

28 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
29
3 0 hereby approves the issuance of an amended Lounge Retail Liquor -Class I License to 2650
31
32 LLC d /b/a Adrienne 's Bar, for the business located at 121 West Main Street, Prattville , AL

36 BE IT FURTHER RESOLVED that the Mayor is hereby authorized to negotiate and
37
38 enter into a usage agreement with 2650 LLC d/b/a Adrienne 's Bar to mitigate ingress and
39
40 egress for said proposed extended outdoor space .

8 WHEREAS, keeping garbage and rubbish is a public nuisance that is injurious to the
9
10 public health , safety and general welfare of the community pursuant to Sec. 46-4 , City of
11
12 Prattville Code of Ordinances; and
13
14 WHEREAS, §6-5-122 et seq ., of the Code of Alabama, 1975, as amended , permits the
15
16 City Council of the City of Prattville to declare a public nuisance and abate the same; and
17
18 WHEREAS, the Prattville Police Department Code Enforcement Officer has inspected
19
20 the property and determined the existence of garbage and rubbish at 133 Sycamore Drive ,
21
22 Prattville, AL 36066; and
23
24 WHEREAS, the Autauga County tax records list the property owner as Rodgers Roger
25
26 D, with an address of 133 Sycamore Drive, Prattville , AL 36066 to parcel number 19 02 03 3
27
2 8 011 012 .000 ; and

30 WHEREAS, in compliance with Sec. 46-31 of the City of Prattville Code of Ordinances,
31
32 the Prattville Police Department Code Enforcement Officer sent notice to the owner of said
33
34 property, in writing, on February 1, 2022 , to correct, remedy or remove the garbage and rubbish
35
36 within ten (10) days; and
37
38 WHEREAS, the owner of 133 Sycamore Drive, Prattville , AL 36066 has failed and/or

40 refused to correct, remedy or remove the garbage and rubbish after the expiration of said
41
4 2 notice; and

44 WHEREAS, Sec. 46-32 of the City of Prattville Code of Ordinances authorizes the City
45
46 to do such work or make such improvements that are necessary to correct, remedy or remove
47
48 such condition , pay therefore and charge the ex penses incurred to the owner of such lo t.

50 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Prattville
51
5 2 declares that the garbage and rubbish at 133 Sycamore Drive , Prattville , AL 36066 continues
53
54 to be a nuisance .
55
56 BE IT FURTHER RESOLVED that the Mayor shall have the garbage and rubbish at 133
57
58 Sycamore Drive, Prattville , AL 36066 removed using City forces or private contractors. The
59
60 property owner shall have the right to remove the garbage and rubbish at his or her own
61
62 expense provided that the removal is done prior to the commencement of work by employees
63
64 or agents of the City of Prattville. The Mayor shall keep an accounting of all costs related to
1 this request and report such cost to the City Council following its removal.
