Preliminary Plat: Glennbrooke Subdivision, Phase 9 29 Location: South of Old Ridge Road, west of Glennbrooke Subdivision, Phase 8 30 Petitioner: SMB Land, LLC 31 Representative: Barrett-Simpson, Inc. 32 33 Mr. Rigsby introduced the preliminary plat of Glennbrooke Subdivision Phase 9. He stated that the 34 approximate 95-acre lot will be developed under R-3 zoning for 146 residential lots which includes two 35 amenity lots. 36 37 Blake Rice of Barrett-Simpson, Inc., petitioner’s representative was present. 38 39 Chairman Smith opened the floor for public comments. George McCarthy, Old Ridge Road, asked questions 40 about plans for traffic abatement, future plans for sewer connection to the west and plans for repairing the 41 deteriorating fence at Ridge at Pratt Farms. 42 43 After no further comments, the public hearing was closed. Mr. Gardner introduced a resolution recommending 44 approval of the preliminary plat of Glennbrooke Subdivision, Phase 9 and moved for its approval. Mr. Mullins 45 seconded the motion. 46 47 Mr. Stephens stated that the City Engineer reviewed the proposed plans and did not express a need for additional 48 traffic control. Mr. Rice addressed the other issues of concerns. 49 50 Mr. Gardner recommended placing temporary speed bumps to help with traffic control. Mr. Rice stated that he 51 would like to further discuss that and other ideas with the City Planner and City Engineer on the most effective 52 approach. 53 54 The vote was called. He stated that the 116 plat is dividing .87 acres out of approximately 7 acres. 117 118 Brad Flowers of Flowers & White Engineering, LLC, petitioner’s representative, presented the 119 preliminary plat of Prattville Square Shopping Center Plat 2. He stated that the property is being 120 subdivided for purposes of selling. The current cross parking and cross access will remain. 121 122 Chairman Smith opened the floor for public comments. There were none. Preliminary Plat: Redfield Ridge Subdivision 130 Location: Redfield Road, north of Eastwood 131 Owner: Redfield Prattville, LLC 132 Representative: Flowers & White Engineering, LLC 133 134 Mr. Rigsby introduced the preliminary plat of Redfield Ridge Subdivision. He stated that the 135 approximately 23 acre parcel will be designed for 75 residential lots under R5 zoning standards and is 136 consistent with the sketch plan that was approved in December 2021. 137 138 Brad Flowers of Flowers & White Engineering, LLC, petitioner’s representative, presented the 139 preliminary plat of Redfield Ridge Subdivision. He stated that they have complied with and met the 140 conditions as required with the approved sketch plan. 141 142 Chairman Smith opened the floor for public comments. Billy Barrett, 2455 Eastwood Blvd., 143 representative of the Homeowner’s Association of Eastwood Subdivision. He stated that they are not 144 opposed to the development, but has concerns about the access. They would like to see the access extend 145 from Redfield Road to Legends Blvd. He was also concerned that the current retention pond would not 146 be able to accommodate increased storm water runoff. 147 148 June Mabry, 2472 Eastwood Blvd., stated concerns about Eastwood Blvd. being the main access could 149 potentially obstruct emergency vehicles response. After no further comments, the public hearing was 150 closed. 151 152 Mrs. Carpenter introduced a resolution recommending approval of the preliminary plat of Redfield Ridge 153 Subdivision and moved for its approval. Mr. Mullins seconded the motion. 154 155 In their discussion, the Commission addressed possible access to the north for construction entrance and 156 advised that the developer give careful attention to the retention pond. He stated that the plat is 169 dividing one 3.64 acre lot into two parcels. He stated that the current zoning of the lot is T-2 which is no 170 longer included in the current zoning ordinance. 171 172 Chairman Smith opened the floor for public comments. Gina Dunbar, adjacent property owner, 173 concerned that trailers or a business could be developed on the property. Chairman Smith stated that the 174 property is currently zoned for trailers under its current T-2 zoning. 175 176 Mr. Williams explained that currently there are no submitted plans for development. He further stated 177 that T-2 zoning does allow for uses allowed in a R-3 zoning which includes single family residential. 178 179 Charles Hall, 876 Lower Kingston Road, also had questions about the preliminary plat being developed. 180 After no further comments, the public hearing was closed. Street Connectivity: Parcel has approximately 440 feet of frontage along North Memorial Drive Water/Sewer: Public water and sewer are available in the vicinity of this site. E. COMPREHENSIVE PLAN: The subject site has a Future Land Use Map (FLUM) designation of Low-Density Residential. On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The applicant would like the land use to match the zoning. It is currently being utilized as a commercial. It is the belief of the Planning Department that when this parcel of land was annexed into the City of Prattville it was given F.A.R zoning, which was standard at that time, but never rezoned to anything else. Street Connectivity: The proposed plat connects Old Farm Way and Old Farm Way connects to Fairview Ave. Water/Sewer: Public water and sewer is available E. The proposed Zoning Map Amendment to B-2 General Business meets the general fabric of the area. PLANNING STAFF EVALUATION: The Neighborhood Shopping Center was constructed in 2004. It is the belief of the Planning Department that when this parcel of land was annexed into the City of Prattville it was given F.A.R zoning, which was standard at that time. Today, we give a pre-zoning when annexing land so that the Planning Commission when granting an annexation can also grant zoning based on the land use and surrounding zoning. The applicant is requesting to rezone 1.90 acres of property from F.A.R to B-2 (General-Business). A variance has been requested to enclose an existing bank canopy in a F.A.R district (Forest, Agricultural, Recreation). The land use is commercial even though it is zoned F.A.R. In a F.A.R district, commercial business is not allowed, therefore if a commercial business does exist within a F.A.R district it is considered legal non-conforming. A legal nonconforming structure may not alter, enlarge, or intensify in any way that increases the nonconformity and the enclosed bank canopy will enlarge the structure by 8 feet on each side. The future land use map has this area designated as a Commercial area. Rezoning the parcels will be consistent with FLUM. Water/Sewer: Public water and sewer is available R-5 (Patio Home Residential) District Standards: Lot requirements for uses in R-5 zoning include the following: MINIMUM SETBACKS AND YARD SIZES:  Front—20 feet  Rear—15 feet  Sides— 5 feet & 0 feet MINIMUM/MAXIMUM LOT SIZE:  Minimum Area—4,000 square feet  Minimum Width at Building Line—40 feet  Maximum Lot Coverage—100 percent Staff Comments: This proposed preliminary plat is consistent with the Sketch Plan approved in October 2021. This Sketch plan was approved under previous zoning requirements and therefore, development standards, setbacks, and other requirements will follow the previous Zoning Ordinance (see Council Ordinance 2022-008). The modified parcels create a primary lot (Lot 2A) that includes a portion of the existing shopping center building. Lot 2A will gain an additional access to E. Main from Lot 4A. This leaves Lot 4A, a currently vacant lot in the southwest corner of the development. The proposed plat creates a landlocked lot that does not have direct access to a public street. A waiver is required to allow the subdivision of a parcel that does not have direct access to a public street. All parcels also have access to existing water and sewer facilities. City Staff reviewed the Resurvey of Lots 2 & 4 of the Map of Prattville East Commercial Plat No. 5 preliminary plat and have provided minor comments for developer to address, including documentation of an shared access agreement granting Lot 4A an Access Easement to access E. COMPREHENSIVE PLAN: On April 15, 2021, the Planning Commission adopted Project Prattville 2040, an updated comprehensive plan. The proposed Zoning Map Amendment to B-2 meets the existing use and general fabric of the area. PLANNING STAFF EVALUATION South Memorial Drive is a major traffic and commercial corridor through the City, and at this location, is a four- lane, divided highway (ALDOT managed). This area of S Memorial Drive has been zoned B-1 for some time. However, many of the existing uses are in conflict with the B-1 zoning. Some of the prohibited uses in B-1 include: Farm Support Business, Vehicle and Equipment Sales and Rental, and Major Automobile Repair. Many of the existing businesses would be considered nonconforming. Based on the location, type of roadway, FLUM, and existing uses, staff feel that this area would be more appropriately zoned B-2 (General Business).
