WS Minutes 2022.08.23PRATTVILLE CITY COUNCIL WORK SESSION MINUTES TUESDAY, AUGUST 23, 2022 6:00 P.M. The Prattville City Council held a Work Session on Tuesday, August 23, 2022, at 6:00 p.m. in the Council Chambers at City Hall. Roll was called with all Councilors recorded as present with the exception of Councilor Starnes. Council President Boone declared a quorum and called the Work Session to order. Council President Boone mentioned that Councilor Starnes was not present this evening due to military duties and thanked him for his service. Mayor Bill Gillespie, Jr. was recorded as being present, in addition to the following staff: Clerk Paula G. Barlow, Finance Director Daniel Oakley, City Attorney Andrew Odom, Assistant City Clerk Dawn Russell, Deputy Finance Director Carlee Sims, and City Planner Scott Stephens. Council President Boone opened the Work Session and explained that tonight's meeting was casual in nature. She reminded all in attendance that the document being reviewed tonight has not been read in during any regular City Council meeting. Councilors would go through the Short -Term Rental draft ordinance page by page, thus allowing changes to verbiage as the Council sees fit. A copy of the draft ordinance is attached as part of the official Minutes. *Page 1 It was the consensus of the Council to lower the Short -Term Rental business license rate to $250.00. *Page 2 It was the consensus of the Council to change the period of time under the definition of "short- term rental" and "transient" from 180 days to 30 days. There was discussion to include mandating that managers hold a broker license if they were not listed as the primary homeowner. There was discussion to include a definitive age "at least 19 years of age or older" within the definition of "local responsible party". *Page 3 To allow for flexibility, there was discussion to include "or designee" after references of "a local responsible party" within Section 38-701 (3). After extensive discussion regarding parking, Mayor Gillespie suggested to strike mention of parking and those restrictions and place a reserved section within the draft for future use. Council President Boone reiterated that at any time after a short-term rental ordinance was in place, the Council had the authority to revisit the ordinance for changes, so it was agreed to strike parking references and include a reserved subsection within Section 38-701. Additionally, discussion on occupancy levels and the definition of 'family" within the City's zoning ordinance ensued as related to verbiage within Section 38-701 (8). City Planner Scott Stephens will confer with the Planning Commission regarding adjustments to Appendix A - Zoning, possibly including an exception for this type of business in residential areas and zones. `Page 4 It was the consensus of the Council to lower the number of surveillance cameras to a minimum of two (2) exterior operational surveillance cameras and edit their location to "cover all entrances to the residence" in Section 38-701 (10). *Page 5 After discussion regarding verbiage in Section 38-703, Finance Director Daniel Oakley will provide the Council clarification and/or streamlined definitions to the Council on late payment, delinquency and failure to pay. It was clarified that the Finance Department is capable and will provide reporting forms to the Council referencing lodging fees and taxes levied. *Page 6 After discussion regarding verbiage in Section 38-706 (7), City Planner Scott Stephens will confer with the City's Chief Building Inspector and established codes to verify if "emergency lighting egress" means an illuminated exit sian or simniv vicihiv lit AYit .rnnnAmwe *Page 7 After discussion regarding verbiage in Section 38-706 (7)(b), it was reiterated that sprinklers only applied to commercial property and not single family residentially zoned homes. There was discussion in keeping the subsection for application purposes, but it will require further clarification from the City's Chief Building Inspector. Council President Boone advised that the Council would like clarifications as soon as possible so the draft document can be edited before placing the ordinance on the City Council agenda. Councilor Gornto and Council President Pro Tempore Strichik thanked the public for sending in their questions, concerns and comments prior to the Work Session.
