CITY OF PRATTVILLE PLANNING COMMISSION 1 MINUTES 2 3 October 20, 2022 4 5 Call to order: 6 Chairman Reuben Gardner called the regular meeting to order at 3:00 p.m. 7 8 Roll Call: 9 Mr. Stephens called the roll. Members present were Mayor Bill Gillespie, Chairman Reuben Gardner, 10 Vice-Chairman Ken Daniel, Deputy Fire Marshal Craig Allen, Mrs. Paula Carpenter, and Mr. Seth 11 Hayden. Mr. Robert King and Mr. Mugs Mullins Councilman were absent. 12 13 Councilman John Chambers arrived at 3:06pm. 14 15 (Quorum present) 16 17 Staff present: Mr. Scott Stephens, City Planner; and Mr. Tommie Williams, Planner. 18 19 Committee Reports: 20 21 Old Business: 22 23 1. Zoning Amendment: FAR, R-2, and B-2 to R-3 (Single Family Residential)24 Location: East of Highland Ridge Subdivision 25 Petitioner: Carolyn Peddy Bryan, et al 26 Representative: Flowers & White Engineering, LLC, 27 28 Mr. Williams introduced the item that was postponed from the previous meeting. Kenneth White, of 29 Flowers & White, was present for the petitioner. 30 31 Mayor Gillespie expressed the need for the connection on Wee Lovett Dr into Highland Ridge to be 32 designed in such a way to discourage cut-through traffic or speeding between the two developments. He 33 suggested to consider a roundabout. He also stated that the connection to Old Farm Lane would be 34 required and preferred that the connection to the Exchange be considered to the south. The Mayor 35 discussed the desire for trees, shrubs, or some other kind of barrier along the north side of the proposed 36
drive to Old Farm in order to protect the existing residents. 37 38 Chairman Gardner opened the public hearing again. 39 40 Craig Simpler, 622 Castlebrook Drive, also the president of the Highland Ridge HOA, expressed his 41 concern about a connection to Wee Lovett Drive/Chancellor Ridge Road. He stated the neighborhood 42
opposed a connection. 43 44 Mary Burt, 1937 Chancellor Ridge Rd, suggested adding two entrances onto Old Farm Ln, and did not 45 like the idea of a connection to Highland Ridge. 46 47 Wade Neuman, 603 Ashton Oak Dr, said he felt a tertiary entrance to the south would increase access for 48 public safety. 49 50 Mayor Gillespie offered a final comment about considering a connection to Howard Murfee Drive. 51 52 Mrs. Carpenter introduced a resolution recommending the rezoning to R-3 and moved for its approval. 53 Mr. Daniel seconded the motion. The vote was called and the motion to approve passed unanimously. 54 55 56

62 Mr. Stephens notified the Commission that the petitioner had requested to postpone this request until the 63 November 17th meeting. 64 65 3. Preliminary Plat: South Industrial Park Plat 1A 66 Location: South Industrial Park Drive 67 Petitioner: City of Prattville 68 Representative: Alabama Land Surveyors, Inc. 69 70 Mr. Williams introduced the preliminary plat. He explained that the City was proposing the plat to cut 71 out the sewer pump station from the larger parcel. Staff had reviewed and was satisfied with the plat. 72 73 Chairman Gardner opened the public hearing. With no one from the public requesting to speak, Mr. 74 Gardner closed the public hearing. 75
76 Mr. Daniel introduced a resolution approving the preliminary plat and moved for its approval. Chief 77 Allen seconded the motion. The vote was called and the motion to approve passed unanimously. 78

Existing Land Use: Undeveloped / Storage Warehouse / Community Events
B. EVALUATION/COMMENTS: The City recently purchased the property along the Autauga Creek, west of South Court Street and south of West Fourth Street. When acquired, there was a block warehouse on site that has since been razed and removed. The metal-sided warehouse currently on-site will remain for storage. Note that the ‘Picker House’ is on a separate lot, is not part of this request, and is owned by the Historic Prattville Redevelopment Authority.
The City intends for this site to be used as a park site for the benefit of the community. Uses may include community events and activities (e.g. Parade of Pumpkins, Christmas Tree, ice skating rink, food trucks), as well as overflow parking during events or for surrounding businesses. There are no current plans to make additional changes to the area, but any that may occur will be in keeping with the intended character of a park and gathering
space for residents. This area is located within the Prattville Historic District and any exterior changes will first need to receive a Certificate of Appropriateness from the Prattville Historic Preservation Commission. Code of Alabama 1975, § 11-52-11 states:
Whenever the commission shall have adopted the master plan of the municipality or of one or more major sections or districts thereof, no street, square, park, or other public way, ground or open space or public building or structure or public utility, whether publicly or privately owned, shall be constructed or authorized in the municipality or in such planned section and district until the location, character, and extent thereof shall have been submitted to and approved by the commission; provided, that in case of disapproval the commission shall communicate its reasons to

the council, which shall have the power to overrule such disapproval by a recorded vote of not less than two thirds of its entire membership; provided further, that if the public way, ground, space, building, structure, or utility is one the
authorization or financing of which does not, under the law or charter provisions governing same, fall within the province of the municipal council, then the submission by the planning commission shall be to the board, commission, or body having such jurisdiction and the planning commission's disapproval may be overruled by said board, commission, or body by a vote of not less than two thirds of its membership. The failure of the commission to act within 60 days from and after the date or official submission to the commission shall be deemed approval.
