Members present were Mayor Bill Gillespie, Councilman John Chambers, Chairman Reuben Gardner, Deputy Fire Marshal Craig Allen, Mr. Seth Hayden, Mr. Robert King, and Mr. Mugs Mullins. Vice-Chairman Ken Daniel and Mrs. Paula Carpenter were absent. (Quorum present) Staff present: Mr. Scott Stephens, City Planner; Mr. Tommie Williams, Planner, and Ms. Alisa Morgan, Secretary. Minutes: Mayor Gillespie moved to approve the minutes of the September 15, 2022 and October 20, 2022 regular meetings. Councilman Chambers seconded the motion. The motion passed unanimously. Committee Reports: Old Business: 1. Preliminary Plat: Jimmy Morris Plat 1 Location: MLK Jr., Drive and Isom Street Petitioner: Jimmy Morris Representative: Hayden Surveyors Mr. Stephens notified the Commission that the petitioner had requested to withdraw this request and will reapply for a future meeting. New Business: 2. Review and Consideration of Spillway Park Location: West of S Court Street, South of W 4th Street Petitioner: City of Prattville Mr. Stephens presented the Spillway Park for consideration and approval. He stated that this request follows the Code of Alabama 1978, Section 11-52-11 to be considered for compliance with location, character, and extent thereof for approval by the commission. He stated that the “Picker House” is on a separate lot and is not part of this request. Mr. Mullins introduced a resolution approving the “Spillway Park” for acceptance and use as a park and recreation area and moved for its approval. Mr. King seconded the motion. The vote was called and the motion to approve passed unanimously. 3. Review and Consideration of Other City Parks Location: Various Petitioner: City of Prattville Mr. Stephens stated that this request is to bring all of the city’s current parks and recreation facilities into compliance with Code of Alabama 1978, Section 11-52-11. He stated that a list of the parks has been provided in the staff report. Mr. Mullins seconded the motion. The vote was called and the motion to approve passed unanimously. Miscellaneous: Mr. Stephens notified the Commission of South Court Street Plat 1 was approved as a minor subdivision. BACKGROUND: Applicant/Representative: City of Prattville (c/o Scott Stephens) Owner: City of Prattville Property Location: West of S Court Street, South of W 4th Street Property Identification: 19 03 08 4 010 001.000 & 19 03 08 3 006 002.000 Property Size: 6.2+/- acres Future Land Use Map (FLUM) Designation: Conservation/Greenspace Current Zoning District: B-2 (General Business) Existing Land Use: Undeveloped / Storage Warehouse / Community Events B. EVALUATION/COMMENTS: The City recently purchased the property along the Autauga Creek, west of South Court Street and south of West Fourth Street. When acquired, there was a block warehouse on site that has since been razed and removed. The metal-sided warehouse currently on-site will remain for storage. Note that the ‘Picker House’ is on a separate lot, is not part of this request, and is owned by the Historic Prattville Redevelopment Authority. The City intends for this site to be used as a park site for the benefit of the community. Uses may include community events and activities (e.g. Parade of Pumpkins, Christmas Tree, ice skating rink, food trucks), as well as overflow parking during events or for surrounding businesses. There are no current plans to make additional changes to the area, but any that may occur will be in keeping with the intended character of a park and gathering space for residents. This area is located within the Prattville Historic District and any exterior changes will first need to receive a Certificate of Appropriateness from the Prattville Historic Preservation Commission. Code of Alabama 1975, § 11-52-11 states: Whenever the commission shall have adopted the master plan of the municipality or of one or more major sections or districts thereof, no street, square, park, or other public way, ground or open space or public building or structure or public utility, whether publicly or privately owned, shall be constructed or authorized in the municipality or in such planned section and district until the location, character, and extent thereof shall have been submitted to and approved by the commission; provided, that in case of disapproval the commission shall communicate its reasons to Page | 2 the council, which shall have the power to overrule such disapproval by a recorded vote of not less than two thirds of its entire membership; provided further, that if the public way, ground, space, building, structure, or utility is one the authorization or financing of which does not, under the law or charter provisions governing same, fall within the province of the municipal council, then the submission by the planning commission shall be to the board, commission, or body having such jurisdiction and the planning commission's disapproval may be overruled by said board, commission, or body by a vote of not less than two thirds of its membership. The failure of the commission to act within 60 days from and after the date or official submission to the commission shall be deemed approval.
