Preliminary Plat: Devers Subdivision 24 Location: South Memorial Drive 25 Petitioner: The Broadway Group, LLC 26 27 This item was held at the previous (March 2nd) special meeting. Mr. Stephens provided background 28 comments on the preliminary plat of Devers Subdivision. He stated that the preliminary plat didn’t meet 29 minimum standard of submission, but has since been completed. A waiver request to eliminate the 30 sidewalks requirement was denied at the previous meeting. He stated that the petitioner needs to obtain 31 formal approval from ALDOT (Alabama Department of Transportation) to approve access to the 32 subdivision. 33 34 DeAnna Hyche of The Broadway Group, LLC, petitioner’s representative, presented the preliminary plat 35 of Devers Subdivision. She stated that they have been in communication with ALDOT and their plans are 36 in the final review. ALDOT has required that they provide a left turn lane on South Memorial Drive to 37 provide access to the property. They have not allowed for sidewalks on South Memorial Drive. She 38 stated that they are not able to acquire additional land to accommodate for sidewalks on the property. She 39 also stated that not being able to acquire additional land has caused the inability to increase the loading 40 zone area which will cause five parking stalls to be blocked during that time. 41 42 After their discussion, the vote was called. Mr. Mullins moved to amend to eliminate the sidewalk 43 requirement for the preliminary plat of Devers Subdivision. Councilman Chambers seconded the motion. 44 Mayor Gillespie expressed his desire to see sidewalk on the property. 45 46 After no further discussion. the vote was called. The motion to approve the waiver to eliminate sidewalk 47 requirements passed by 7/2 vote as recorded. Favor: Mr. Mullins, Councilman Chambers, Mr. Hayden, 48 Mr. Allen, Mrs. Carpenter, Mr. Daniel, and Chairman Gardner. Oppose: Mr. King and Mayor Gillespie. 49 50 The vote was called on the motion as amended. Speaks & Associates, Inc. 65 66 Mr. Stephens provided the staff report for the preliminary plat of Laney Property Plat 2. He stated that 67 the plat proposes a temporary turn around. He stated that the city’s engineer would prefer the road to be 68 complete. 69 70 Greg Gillian of Larry E. Speaks & Associates, Inc., petitioner, presented the preliminary plat of Laney 71 Property Plat 2. He stated that the road will be completed with development of the next plat. 72 73 Chairman Gardner opened the floor for public comments. There were none to speak. The public hearing 74 was closed. 75 76 Mayor Gillespie discussed concerns about traffic on Old Farm Lane and whether modifications to the 77 median might be required. 78 79 Mayor Gillespie introduced a resolution recommending approval of the preliminary plat of Laney 80 Property Plat 2 and moved for its approval. Mr. Mullins seconded the motion. The motion to approve 81 passed unanimously. 82 83 3. Preliminary Plat: S Industrial Park Plat 3A 84 Location: County Road 4 E, South Industrial Park 85 Petitioner: City of Prattville 86 87 This item was postponed (to the May meeting) at the petitioner’s request. 88 89 4. Master Plan: Riverfell PUD 90 Location; Highway 82 E Bypass 91 Owner: Riverfell I, LP; (RFA 1/RFB I/RFD I) 92 Representative: Riverfell I, LP-Halieus, LLC 93 94 Mr. Stephens stated that the staff conferred with the petitioner and made a request to postpone the action 95 on the Master Plan of Riverfell to allow for staff to be able to have a thorough review of the submission. 96 The petitioner’s representative, Bradley Neave, and staff met on April 17 to discuss questions and receive 97 more clarification. 98 99 Mr. Neave stated that under advisement of city staff, they request to postpone action at today’s meeting 100 with hopes of consideration for a special called meeting by the commission. 101 102 This item was postponed at the petitioner’s request. He stated 111 that the plat proposes to subdivide 8.42 acres into 3 single family residential lots. He stated that the applicant is requesting to rezone the 137 approximately 1.68 acre parcel from a split zoning of B-2 (General Business) and R-3 (Single Family 138 Residential) to B-2 (General Business). The reason for this split was the reconfiguration of the parcel 139 during platting to accommodate the McQueen Smith Road widening project. He stated that the proposed 140 rezoning will eliminate the current split zoning of this parcel and will create a uniform parcel zoned B-2 141 General Business. 142 143 Harold Hale of Webb Builders, Inc., petitioner’s representative, presented the rezoning amendment 144 request from HD & D Land Company. 145 146 Chairman Gardner opened the floor for public comments. Master Plan: Riverfell PUD 27 Location; Highway 82 E Bypass 28 Owner: Riverfell I, LP; (RFA 1/RFB I/RFD I) 29 Representative: Riverfell I, LP-Halieus, LLC 30 31 Mr. Stephens provided the staff report for the Master Plan of Riverfell PUD. He explained the objective 32 and process of the PUD approval. The Riverfell PUD zoning was approved by City Council with 33 condition that multi-family would not exceed two stories from ground level, or not exceed two stories 34 above ground floor retail/non-residential. 35 36 Bradley Neave, petitioner’s representative, presented the Master Plan of Riverfell PUD. He stated that 37 Riverfell will offer a wide variety of housing sizes, types, and designs along with differing lot sizes and 38 strategic lot placement throughout the development. Riverfell will also embrace the PUD’s planned 39 purpose of offering a combination of uses through horizontal transition zones, and other thoughtful 40 integrations of residential and commercial uses. He stated that these uses will include senior living, day 41 care, retail town center, greenspace, transition zone, multi-family, single family, townhomes and flats, and 42 office and medical. 43 44 Chairman Gardner opened the floor for public comments with a 3 to 5-minute speaking limit. Jon Lee 45 Finnegan, 211 Deer Trace. She posed questions to the developer and stated that her main worries were 46 traffic impact and who is funding the development. Mr. Stephens and Mr. Neave addressed her 47 comments. On the issue with the traffic study as required by City Council, Mr. Neave stated that they had 48 two studies done. The first was based on the initial design. Some required changes were made to the 49 design which required a second traffic study. He stated that the second study has been done and is 50 waiting to receive it. He stated they will adhere to any and all restrictions imposed in the study. Mr. Mullins seconded the motion. 59 60 After some discussion, Mayor Gillespie moved to amend the motion to restrict the apartments height to 61 two story. Under the Planning Commission’s previously adopted Subdivision Regulations (prior to July 21, 2022) preliminary plat approval was valid for one year, which is what this subdivision was approved under. Park Lane preliminary plat (which includes Phases I, II, &, III) was first approved at the May 21, 2020 meeting. Park Lane Phase 1 was recorded on November 25, 2020 Park Lane Phase 2 was recorded on December 22, 2021. See timeline below May 21, 2020- Park Lane Preliminary Plat (Phases I, II, &, III) approved November 25, 2020-Park Lane Phase I was recorded May 20, 2021- Time extension approved December 22, 2021- Park Lane Phase 2 was recorded May 19, 2022 – Time extension approved In an effort to keep preliminary plats from lingering without development action, the Commission previously offered a solution by placing a limit on the renewal of time extension for preliminary plats. The commission voted to allow up to three (3) time extension approvals for preliminary plats, upon the fourth request the preliminary plat would be referred to a special committee for review. Scott Stephens, City Planner DATE: May 18, 2023 RE: Dawson’s Mill Time Extension Request Please see attached letter requesting a time extension on Dawson’s Mill Plats (Phases) I, II, and III. Under the Planning Commission’s previously adopted Subdivision Regulations (prior to July 21, 2022) preliminary plat approval was valid for one year, which is what this subdivision was approved under. Plat I (which includes Phases I, II, & III) was first approved at the July 20, 2017 meeting and Phase IV was approved in August 2019. The Future Land Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel in Medium-Density Residential zones and surrounded by Medium Density Residential to the North and East and West, Mixed-Use Commercial to the South. The boundaries of land use categories shown on the Future Land Use map should not be interpreted rigidly, but the general pattern should be observed to support comfortable transitions between uses. PLANNING STAFF COMMENTS This property is situated on the corner of McQueen Smith Road and Briarwood Street, adjacent to a large retail use (Walmart) to the south and a fire station (Prattville Fire Station #3) to the east, with professional offices across Briarwood Street to the north and a residential neighborhood (Glynwood) across McQueen Smith Road to the west. This portion of McQueen Smith Road has heavy automobile traffic (2021 AADT 17,027). Any access to this lot would be restricted to Briarwood Street, immediately adjacent to the fire station. The Planning Commission should consider the full range of uses permitted in B-2 zoning, which typically have a moderate to high intensity of use and traffic generation. The existing O-1 (Office) zoning is appropriate, or the Commission may consider B-1 (Neighborhood Commercial) for less intense commercial uses.
