Members present were Mayor Bill Gillespie, Councilman John Chambers Chairman Reuben Gardner, Vice-Chairman Ken Daniel, Deputy Fire Marshal Craig Allen, Mrs. Paula Carpenter, Mr. Seth Hayden, Mr. Robert King, and Mr. Mugs Mullins. None were absent. (Quorum present) Staff present: Mr. Scott Stephens, City Planner and Ms. Alisa Morgan, Secretary. Minutes: Mr. Mullins moved to approve the minutes of the March 2, 2023 special meeting. Mr. Daniel seconded the motion. The motion passed unanimously. Committee Reports: Old Business: 1. Preliminary Plat: Devers Subdivision Location: South Memorial Drive Petitioner: The Broadway Group, LLC This item was held at the previous (March 2nd) special meeting. Mr. Stephens provided background comments on the preliminary plat of Devers Subdivision. He stated that the preliminary plat didn’t meet minimum standard of submission, but has since been completed. A waiver request to eliminate the sidewalks requirement was denied at the previous meeting. He stated that the petitioner needs to obtain formal approval from ALDOT (Alabama Department of Transportation) to approve access to the subdivision. DeAnna Hyche of The Broadway Group, LLC, petitioner’s representative, presented the preliminary plat of Devers Subdivision. She stated that they have been in communication with ALDOT and their plans are in the final review. ALDOT has required that they provide a left turn lane on South Memorial Drive to provide access to the property. They have not allowed for sidewalks on South Memorial Drive. She stated that they are not able to acquire additional land to accommodate for sidewalks on the property. She also stated that not being able to acquire additional land has caused the inability to increase the loading zone area which will cause five parking stalls to be blocked during that time. After their discussion, the vote was called. Mr. Mullins moved to amend to eliminate the sidewalk requirement for the preliminary plat of Devers Subdivision. Councilman Chambers seconded the motion. Mayor Gillespie expressed his desire to see sidewalk on the property. After no further discussion. the vote was called. The motion to approve the waiver to eliminate sidewalk requirements passed by 7/2 vote as recorded. Favor: Mr. Mullins, Councilman Chambers, Mr. Hayden, Mr. Allen, Mrs. Carpenter, Mr. Daniel, and Chairman Gardner. Oppose: Mr. King and Mayor Gillespie. The vote was called on the motion as amended. The amended motion to approve passed unanimously. (The original motion from March 2nd to approve was made by Mrs. Carpenter and seconded by Mr. Allen). Preliminary Plat: Laney Property Plat 2 Location: Fairview Ave. (Hwy 14 E) & West of Old Farm Lane Petitioner: Laney Properties, LTD Representative: Larry E. Speaks & Associates, Inc. Mr. Stephens provided the staff report for the preliminary plat of Laney Property Plat 2. He stated that the plat proposes a temporary turn around. He stated that the city’s engineer would prefer the road to be complete. Greg Gillian of Larry E. Speaks & Associates, Inc., petitioner, presented the preliminary plat of Laney Property Plat 2. He stated that the road will be completed with development of the next plat. Chairman Gardner opened the floor for public comments. There were none to speak. The public hearing was closed. Mayor Gillespie discussed concerns about traffic on Old Farm Lane and whether modifications to the median might be required. Mayor Gillespie introduced a resolution recommending approval of the preliminary plat of Laney Property Plat 2 and moved for its approval. Mr. Mullins seconded the motion. The motion to approve passed unanimously. 3. Preliminary Plat: S Industrial Park Plat 3A Location: County Road 4 E, South Industrial Park Petitioner: City of Prattville This item was postponed (to the May meeting) at the petitioner’s request. 4. Master Plan: Riverfell PUD Location; Highway 82 E Bypass Owner: Riverfell I, LP; (RFA 1/RFB I/RFD I) Representative: Riverfell I, LP-Halieus, LLC Mr. Stephens stated that the staff conferred with the petitioner and made a request to postpone the action on the Master Plan of Riverfell to allow for staff to be able to have a thorough review of the submission. The petitioner’s representative, Bradley Neave, and staff met on April 17 to discuss questions and receive more clarification. Mr. Neave stated that under advisement of city staff, they request to postpone action at today’s meeting with hopes of consideration for a special called meeting by the commission. This item was postponed at the petitioner’s request. A special called meeting was scheduled for May 1, 2023, at 11:00 a.m. 5. Preliminary Plat: Byrd Family Lands Plat 2 Location: 916 Hwy 82 Bypass W Petitioner: Jeremy & Lisa Byrd Representative: Alabama Land Surveyors, Inc. Mr. Stephens provided the staff report for the preliminary plat of Byrd Family Lands Plat 2. He stated that the plat proposes to subdivide 8.42 acres into 3 single family residential lots. He stated that the petitioners are requesting a waiver request of Subdivision Regulations Section 4.3. James Monk of Alabama Land Surveyors, Inc., petitioners’ representative, presented the preliminary plat of Byrd Family Lands Plat 2. Chairman Gardner opened the floor for public comments. There were none. The public hearing was closed. Mrs. Carpenter introduced a resolution recommending approval of the preliminary plat of Byrd Family Lands Plat 2 and moved for its approval. Mr. Stephens introduced the rezoning request of HD & D Land property located at the northwest corner of McQueen Smith Road and Major Avenue. He stated that the applicant is requesting to rezone the approximately 1.68 acre parcel from a split zoning of B-2 (General Business) and R-3 (Single Family Residential) to B-2 (General Business). The reason for this split was the reconfiguration of the parcel during platting to accommodate the McQueen Smith Road widening project. He stated that the proposed rezoning will eliminate the current split zoning of this parcel and will create a uniform parcel zoned B-2 General Business. Harold Hale of Webb Builders, Inc., petitioner’s representative, presented the rezoning amendment request from HD & D Land Company. Chairman Gardner opened the floor for public comments. There were none. The public hearing was closed. Mr. Mullins introduced a resolution recommending approval of the zoning amendment of property located at the northwest corner of McQueen Smith Road and Major Avenue and moved for its approval. Scott Stephens, City Planner DATE: April 14, 2023 RE: Devers Preliminary Plat At your March 2, 2023, meeting, the Devers Preliminary Plat that was submitted was lacking all of the elements as required by the Prattville Subdivision Regulations. During the meeting, a motion was made by Mr Mullins to approve the waiver request of not completing additional street and infrastructure improvements in the right-of-way (e.g. sidewalks and curb & gutter), and it was seconded by Mr Daniel. The motion for the waiver failed with a 4-3 vote (Yes-Mullins, Allen, Carpenter, Daniel; No-Gillespie, King, Gardner). Note that plats need six affirmative votes to pass, and since this is an element of the plat, it also needs six affirmative votes to pass. A motion to approve the plat without waivers was made by Mrs Carpenter and seconded by Mr Allen. During discussion, Mayor Gillespie stated that the plat failed to meet minimum requirements, namely the topographic contours being shown on the plat (§5.2). The petitioner, Ms Hyche, had an updated plat she wished to be reviewed, but it had not been submitted in time and had not been reviewed by staff. Ms Hyche then requested to postpone the consideration of the plat to the April meeting. Mayor Gillespie moved to postpone, Mr Mullins seconded, and the motion to postpone was approved unanimously. The plat as submitted for your consideration at the April 20, 2022, meeting complies with the minimum standards for a preliminary plat. I have spoke with the applicant and he is understanding of the request. Staff and the applicant have a meeting scheduled the week of April 17th to discuss questions and receive more clarification. EVALUATION/COMMENTS: Proposed Use: The applicant is requesting to rezone a 1.68 +/- acre parcel located directly south of Centerpoint Church, from split zoning of B-2 (General Business) and R-3 (Single Family Residential) to B-2 (General Business). Street Connectivity: Parcel has frontage on McQueen Smith Road Water/Sewer: Public water and sewer are available to this site. E. COMPREHENSIVE PLAN: The subject site has a Future Land Use Map (FLUM) designation of Low-Density Residential. On April 15, 2021, the Planning Commission adopted an updated Prattville Comprehensive Plan. The Future Land Use Plan and Map in Land Use + Transportation section (pg. 40) of the document shows the subject parcel in Medium-Density Residential FLUM zones and surrounded by Medium Density Residential to the North and East and West, Commercial to the South. The proposed Zoning Map Amendment to B-2 General Business meets the general fabric of the area. PLANNING STAFF EVALUATION This property has a split zoning designation, with over 80 % being B-2 (General-Business) and the remaining back portion of the parcel (~20%) is zoned R-2 Single Family Residential. The FLUM zone for this parcel is Medium- Density Residential. The McQueen Smith corridor on the corner of Hwy 82 is mostly B-2 (General-Business), the proposed zoning of this parcel will maintain that general fabric of the area. The proposed zoning map amendment will eliminate the current split commercial/residential zoning of this parcel and will create a uniform parcel zoned B- 2 General Business.
