Preliminary Plat: Strickland Subdivision 27 Location: 424 and 444 Wetumpka Street 28 Owners: Samuel D. He stated that the proposed plat 32 moves the shared lot line between the two existing lots 33ft to the east. He stated that this plat was heard 33 in May 2021 but the final plat was never recorded and the approval of the preliminary plat expired. He 34 stated that the two lots would remain compliant with the Zoning Ordinance. He also stated that the 35 petitioner is requesting a waiver from the sidewalk requirements. There are no existing sidewalks in the 36 area. 37 38 Chairman Gardner opened the floor for public comments. There were none to speak. The public hearing 39 was closed. 40 41 Mayor Gillespie discussed the importance of sidewalks in a subdivision and was favorable to waiving the 42 sidewalks in this area since there are none existing. 43 44 Mrs. Carpenter introduced a resolution approving the waivers of Strickland Subdivision Plat 1 and moved 45 for its approval. Mr. Mullins seconded the motion. The motion to approve the waivers passed 46 unanimously. 47 48 Mrs. Carpenter introduced a resolution approving the preliminary plat of Strickland Subdivision Plat 1 49 with waivers and moved for its approval. He stated that the petitioner plans to develop the property for commercial 62 business with one structure. 63 64 Chairman Gardner opened the floor for public comments. There were none to speak. The public hearing 65 was closed. 66 67 Mr. Mullins introduced a resolution approving the waivers of Nichols Group Plat 1 and moved for its 68 approval. Mr. Allen seconded the motion. 69 70 In their discussion, Mayor Gillespie stated that the street has direct connection to an existing sidewalk and 71 he does not support the waiver. 72 73 The motion to approve the waivers failed by 1/5 vote as recorded. He stated that the developer is requesting to rezone the northern portion of the property of the 88 existing Christ Lutheran Church. 89 90 Brad Flowers of Flowers & White Engineering, LLC, petitioner’s representative, presented the rezoning 91 request for the property located at 2175 Cobbs Ford Road. Mr. Monk stated that he is 121 willing to make that request noted on the final plat. 122 123 After their discussion, the vote was called. Speaks & Associates, Inc. 133 134 Mr. Stephens provided the staff report for the preliminary plat of Prattville Farm Center Plat 1. He stated 135 that the developer is requesting to reconfigure the interior property lines of the existing two lot 136 commercial property. He is also requesting waiver from the street improvements. 137 138 Greg Gillian of Larry E. Speaks & Associates, Inc., petitioner’s representative, presented the preliminary 139 plat of Prattville Farm Center Plat 1. He stated that the northern portion is being carved out for the 140 purpose of selling. He also stated that there is an existing joint use easement to the property. 141 142 Chairman Gardner opened the floor for public comments. Rubye Davis, 103 Sara Lane had questions 143 about the development of the lot at the end of Sara Lane. Mr. Gillian addressed the comment stating that 144 there are no proposed changes to the existing layout. After no further comments, the public hearing was 145 closed. 146 147 Mayor Gillespie introduced a resolution approving the waivers of Prattville Farm Center Plat 1 and 148 moved for its approval. Mrs. Carpenter seconded the motion. 149 150 After their discussion, the vote was called. The motion to approve the waivers passed unanimously. 151 152 Mayor Gillespie introduced a resolution approving the preliminary plat of Prattville Farm Center Plat 1 153 with waivers and moved for its approval. The motion to approve passed 154 unanimously. 155 156 Miscellaneous: 157 The Commission decided on a future work session to address some issues within the Subdivision 158 Regulation as pertaining to sidewalks. 159 160 Jon Lee Finnegan, 211 Deer Trace, addressed the Commission about the Riverfell PUD regarding the 161 traffic study that has been released for the project. The church is in negotiations to sell Lot 2 to an adjacent property owner and it will be combined with the adjacent property at a later date. We would like to request three waivers for this plat. 1) Waiver to the requirement for the installation of a sidewalk along the frontage of Lot 1 at Cobbs Ford Road. 2) Waiver for Lot 2 as it does not front a public street. 3) Waiver for contours and utilities. Sidewalk Waiver: There is no sidewalk on either side of Cobbs Ford Road from the interstate to the downtown area of Prattville. The church is not doing anything to their property (Lot 1) that would change the use or functionality of the lot and they are not a “walking membership” that will change their means of access to the building if a sidewalk is installed. Please consider waiving this requirement. Street Frontage Waiver: As I discussed with the Planning Commission in the rezoning hearing for this property, the ultimate goal for Lot 2 is the combination with the Stivers property to the east. However, for this plat, the lot is a standalone lot until the property sale takes place. At the time Stivers brings a master plan to the city, Lot 2 will be combined with the existing Stivers property and thus it will have frontage. For this plat, we have provided an offsite access easement that will be dedicated by Stivers for means of legal access to Lot 2. This provides a means to keep the lot from being land locked and thus giving it “access to a public street” to meet the intent of the subdivision requirement.
